1. Who you are contracting with

Tilecast ("Tilecast", "we", "us") provides an online room visualization service for tile and flooring retailers. These terms form an agreement between Tilecast and you, the subscriber ("you"). If you are agreeing on behalf of a business, you confirm you have authority to bind it; otherwise you confirm you are of legal age to contract.

2. Acceptance

By creating an account, subscribing, or continuing to use the service, you agree to these terms. If you do not agree, do not use the service.

3. The service

Tilecast lets you upload images of your tile and flooring range and gives your customers a page where they can upload a photo of their own room and see your products applied to floors, walls and other surfaces using automated image generation. You may link to or embed that page from your own website.

4. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login details confidential and for all activity carried out under your account.

5. Acceptable use

You must not use the service:

• for any unlawful purpose, or for fraud or spam;
• to upload content you do not have the rights to, or that infringes anyone's intellectual property, privacy or other rights;
• to produce misleading, defamatory, hateful, sexual or otherwise harmful imagery, or images of identifiable people without consent;
• to interfere with the security or operation of the service, including malware, probing, scraping or circumventing technical limits;
• to reverse engineer, resell or redistribute the service.

6. Generated images and accuracy

Room views are produced automatically and are an artistic impression, not a colour-accurate or dimensionally accurate representation. Screen colour, lighting and photo quality all affect the result. You are responsible for how you present generated images to your customers, and for verifying that any claim you make about a product is correct. We recommend showing physical samples before purchase. We may remove content or refuse to generate images that breach these terms.

7. Content you upload

You keep ownership of the product images and other content you upload. You grant us a limited licence to host, process and display that content solely to provide the service to you and your customers. Customer room photos are processed to produce the requested image and are not used for anything else. If a rights-holder contacts us about content on your shop page, we may remove it; repeated infringement may end your account.

8. Our intellectual property

We retain all rights in the service, including the software, design and Tilecast branding. Your subscription grants a limited, non-exclusive, non-transferable right to use the service within your chosen plan.

9. Plans, payment and cancellation

Subscriptions are monthly and renew automatically until cancelled. Each plan includes a 14-day free trial; a payment method is required to start the trial and the first charge is taken when the trial ends unless you cancel before then. You can cancel or change your plan at any time from your dashboard; cancellation takes effect at the end of the period you have already paid for, and you keep access until that date.

Payment, billing, tax and refund mechanics are handled by our reseller and are governed by the Paddle Buyer Terms. Our refund policy is set out on our Refund Policy page.

10. Reseller / Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

11. Service level

We work to keep the service available and accurate, but we do not guarantee uninterrupted or error-free performance. Automated image generation depends on third-party providers and may occasionally be slow or unavailable.

12. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, your shop page stops being available and you may export your product list for 30 days before we delete it.

13. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including lost profits, lost data or lost goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it.

14. Indemnity

You will indemnify us against claims arising from content you upload, your unlawful use of the service, or your breach of these terms.

15. General

You may not assign this agreement without our consent; we may assign it as part of a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of Ireland and the Irish courts have exclusive jurisdiction.
